Deferred Action for Childhood Arrivals

If you came to the United States for the first time when you were a young child, it may be that you qualify for deferred action for childhood arrivals.  When one receives deferred action, it means that the Department of Homeland Security will not commence deportation proceedings against him/her (it is “deferring” its enforcement authority).  Those who qualify may also apply for and receive employment authorization.  Generally, if you:

·         Arrived in the United States before you turned age 16

·         Arrived in the United States prior to June 15, 2007

·         Have remained continuously present in the United States since June 15, 2007

·         Graduated from high school in the United States, received a “GED” here or are in the process of completing courses in order to receive a  “GED”

·         Have not been convicted of certain crimes

Executive Action by President Obama

On November 20, 2014, President Obama announced a program of executive action called DAPA, or Deferred Action for Americans and Lawful Permanent Residents.  This program is currently suspended by federal court order.  On November 9, 2015, the Fifth Circuit Court of Appeals upheld the district court's preliminary injunction. Auto accidents

Payment of Medical Expenses and Lost Wages

If you have been injured in an auto accident, you should consult with Nelson L. Peralta of Peralta Law Firm.  Under Minnesota law, your own auto insurance policy provides you with certain rights.  Your own auto insurance can cover:

·         Your necessary and reasonable medical expenses, up to a limit of $20,000

·         Your lost wages, up to a limit of $20,000

·         Other expenses, such as mileage expense incurred to receive treatment

 

It is not true that you are guaranteed to receive $20,000 or $40,000.  Under the letter of the law, your No-Fault insurance is responsible for payment of necessary and reasonable medical expenses.  Many of the legal disputes in this area of the law focus on whether the medical expenses incurred were “necessary and reasonable.”  Your No-Fault insurance may deny payment to your doctor if it concludes that certain of your medical expenses were not “necessary and reasonable.”

In certain situations, when your No-Fault insurance company has denied payment to your doctor for medical expenses related to an auto accident, it is necessary and advisable to commence an arbitration proceeding or file a lawsuit to recoup the outstanding medical expenses.  Nelson L. Peralta is experienced at handling these type of No-Fault claims.  If your insurance company is denying payment of medical expenses, consider consulting with Nelson L. Peralta in order to determine whether you should commence an arbitration proceeding or file a lawsuit against the insurance company.

Compensation for Pain and Suffering

Besides payment of your medical expenses and lost wages, in certain cases you may receive compensation for your pain and suffering following an auto accident.  Generally, you have a right to make a claim against the person who caused the auto accident when:

·         You suffered a permanent injury as a result of the accident, or

·         You were disabled for more than 60 days as a result of the accident, or

·         You incurred more than $4,000 in medical expenses as a result of the accident.

If you were injured in an auto accident and you received medical treatment, you should consult with Nelson L. I-35W Bridge Collapse

Nelson L. Peralta had the honor and privilege of participating in the I-35W Pro Bono Consortium of attorneys who represented survivors of the I-35W Bridge Collapse in Minneapolis on August 1, 2007.  I was invited to participate in the Consortium by the law firm Robins, Kaplan, Miller & Ciresi LLP.  After accepting an invitation to participate, Nelson ultimately represented 10 clients pro bono with their claims against the State of Minnesota.

Many of my clients were students who happened to be riding the Waite House school bus over the I-35W Bridge when it collapsed into the Mississippi River.  Some of my clients were adults who were on their way home from work that day.  All of my clients suffered physical injuries and/or emotional harm as a result of the Bridge Collapse.  All of my clients were, and are, very brave and courageous.

After representing my clients with their claims against the State, I also continued to represent them with their civil lawsuits against two companies in Hennepin County District Court.  After more than two years of litigation, a settlement was reached.  My clients, and many others who were represented by other members of the Consortium, finally received the compensation that they deserved following the Bridge Collapse disaster.  In the end, the vast majority of the children I represented did not pay a single cent for my legal representation.
